DWI Services

Being arrested for driving while impaired can be an overwhelming, scary and embarrassing ordeal.  Services are provided with the strictest  of confidentiality and compassion. without judgement.  Jeff has worked with hundreds of clients to help them not only to restore their driving privileges in multiple states, but also to help them achieve their own personal goals of a life well lived.  

Out of State Reviews

Received a DWI while visiting North Carolina?  You will need to complete an out of state review to document your completion of an assessment and compliance with it's recommendations in order to submit an E508 to NC DMV.  Failure to do so may affect your ability to renew your driver's license in your home state.

Assessment

IF you are convicted of DWI, NC DMV will require you to complete an assessment and any education/treatment recommendations PRIOR to full driver's license reinstatement.  Completing the assessment prior to court is a mitigating factor and may help your case when going to court.   

"What do I need for my Assessment?"

Assessments are confidential and typically take 60-90 minutes.  Assessments consist of a clinical interview, completion of a standardized screening tool, review of your driving record, and review of other pertinent factors.  In order to complete your assessment the following documents are needed:  


  • A copy of your ticket 
  • BAC Report 
  • Driving Record from all states licensed to drive 

"But I don't really drink that much?"

Assessment recommendations are made based on a variety of clinical and administrative factors including ASAM Criteria, diagnosis and BAC.  For an example: Anyone with a BAC of .15 or over, or refused BAC should not be recommended to ADETS according to state statutes.   Assessments and recommendations are completed consistent with North Carolina  10A NCAC 27G .3800.  

"How many hours am I going to have to complete?"

10A NCAC 27G .3813 identifies the following levels of care:

  • ADETS - 16 hours 
  • Short Term - Minimum of 20 hours over 30 days 
  • Long Term - Minimum of 40 hours over 60 days 
  • IOP/Day Treatment - Minimum of 90 hours over 90 days
  • Inpatient/Residential Treatment - 

Many are referred to the first three levels of care. In some cases that require mandatory jail time served, inpatient/residential care may be completed in lieu of jail.  

"What Is your schedule? Can I do this online? "

Short Term & Longer Term Treatment:  We will meet individually to develop a treatment plan consisting of both group and individual treatment to best suit your needs and goals.  Group sessions will allow you to complete the recommendation in a more efficient manor.

Prime for Life 16 hours in 8 - 2 hour group sessions completed in 5-10 days.  Completed in office or on line.  MUST ATTEND ALL SESSIONS in order. .

Tuesday Nights 5:30pm - 7:30pm

A 2 hour group session utilizing both process and psychoeducation formats to assist individuals in developing and utilizing low risk decision making regarding substance use. We will explore low risk drinking guidelines, "successful drinking" and abstinence based models. Individuals will have an opportunity to explore their own progression

A 2 hour group session utilizing both process and psychoeducation formats to assist individuals in developing and utilizing low risk decision making regarding substance use. We will explore low risk drinking guidelines, "successful drinking" and abstinence based models. Individuals will have an opportunity to explore their own progression of use and factors affecting such progression, including but not limited to genetics, tolerance, social influences and personal belief systems.

To facilitate completion of an E508 I need to review the following information:

3. Release TX Providers (Download Above) - Complete one for each treatment/assessment provider.  

4. NC Driving Record -  https://www.ncdot.gov/dmv/offices-services/records-reports/Pages/driving-records.aspx   (Tip: Work on this first so it can be processing by postal mail while you work on the other information)  

5. Driving Records of other states in which you have been licensed to drive.  Driving records do not need to be certified but they do need to be for the longest time period available.   

6. & 7.  Copy of ticket and BAC report.  You may also print to PDF your case information found here:  https://portal-nc.tylertech.cloud/Portal/Home/Dashboard/29   (Tip: Search by file number followed by 3 digit county code.  Example 25CR00000123  Dare County 3 digit code is 270)

A starting point to determine minimum program requirements and points of contact for various states.  This information is updated via third party and clients should coordinate with their treatment provider and an NC Provider to ensure an E508 may be submitted for DWI offense obtained in North Carolina.

Timeline and next steps

Once I have a complete packet we will arrange for a phone call to discuss your case and process payment for your review. Once we process payment your E508 usually clears NC DMV in a week to 10 business days, often sooner.

  1. A prior conviction or guilty plea for DWI if:
    The conviction occurred within seven years before the date of the offense for which the defendant is being sentenced;
    The conviction occurs after the date of the offense for which the defendant is presently being sentenced, but prior to or contemporaneously with the present sentencing; or
    The conviction occurred in District Court, the case was appealed to Superior Court, the appeal has been withdrawn or the case has been remanded back to District Court and a new sentencing hearing has not been held pursuant to G.S. 20‑38.7.
  2. The DWI occurred while  driving with a revoked license because of a prior DWI.
  3. Someone was seriously hurt as a result of the DWI.
  4. A minor child under 18 was in the car during the DWI.

  1. Gross impairment or blood alcohol concentration of 0.15 or more.
  2. Especially reckless or dangerous driving.
  3. Negligent driving that led to a reportable accident.
  4. Driving while license revoked, for any reason other than a prior DWI.
  5. Two or more prior convictions for a motor vehicle offense other than DWI for which at least three points are assigned under G.S. 20‑16 or for which the convicted person’s license is subject to revocation, if the convictions occurred within five years of the date of the offense for which the defendant is being sentenced, or one or more prior convictions for DWI that occurred more than seven years before the date of the offense for which the defendant is being sentenced.
  6. Conviction of speeding by the defendant while fleeing or attempting to elude arrest.
  7. Conviction of speeding by the defendant by at least 30 mph over the legal limit.
  8. Passing a stopped school bus.
  9. Any other factor that aggravates the seriousness of the offense.

Mitigating Factors

 

  1. Slight impairment solely from alcohol, and blood alcohol concentration not more than 0.09.
  2. Slight impairment solely from alcohol, but no chemical analysis available.
  3. Driving was safe and lawful except for the impairment.
  4. A safe driving record, having no convictions for any motor vehicle offense for which at least four points are assigned within five years of the date of the offense for which the defendant is being sentenced.
  5. Impairment caused primarily by a lawfully prescribed drug for an existing medical condition, and the amount of the drug taken was within the prescribed dosage.
  6. Voluntary submission to a mental health facility for assessment after being charged with the impaired driving offense for which he or she is being sentenced and, if recommended by the facility, voluntary participation in the recommended treatment.
  7. Completion of a substance abuse assessment, compliance with its recommendations, and maintaining 60 days of continuous abstinence from alcohol consumption, as proven by a continuous alcohol monitoring (CAM) system. The CAM device must be approved by the Division of Adult Correction (DOC).
  8. Any other factor that mitigates the seriousness of the offense.

DWI Punishment Levels

Aggravated Level One DWI Punishment: N.C.G.S. § 20-179(f3)

 Imposed if three or more grossly aggravating factors are present

  • Fine: Up to $10,000
  • Jail: Minimum of 12 months, maximum of 36 months — with no eligibility for parole
    • But: Imprisonment term can be suspended only if a condition of special probation is imposed requiring a minimum term of imprisonment of at least 120 days
    • If probation is imposed, it must include the condition that the defendant abstain from alcohol for at least 120 days and undergo a substance abuse assessment and related treatment or education

Level One DWI Punishment: N.C.G.S. § 20-179(g)

 Imposed if either:

  • The defendant was accompanied by (i) a child under the age of 18 years, (ii) a person with the mental development of a child under the age of 18 years, or (iii) a person with a physical disability preventing unaided exit from the vehicle at the time of the offense, or
    • Any two of the other grossly aggravating factors are present
  • Fine: Up to $4,000
  • Jail: Minimum of 30 days, maximum of 24 months
    • Imprisonment term may be suspended only if a condition of special probation is imposed including a minimum term of imprisonment of 30 days
    • BUT: A judge may reduce the minimum term of imprisonment required to a term of not less than 10 days if a condition of special probation is imposed to require that a defendant abstain from alcohol consumption and be monitored by a continuous alcohol monitoring system, of a type approved by the Division of Adult Correction of the Department of Public Safety, for a period of not less than 120 days. Pre-trial credit of up to 60 days may be given for alcohol monitoring prior to judgment, toward the 120-day period.
    • If probation is imposed:
      • Probation will include the requirement that the defendant undergo a substance abuse assessment and related treatment or education
      • Probation may include a requirement of abstaining from alcohol, monitored by a continuous alcohol monitoring system, for anywhere between a minimum period of 30 days, up to the maximum of the term of probation

Level Two DWI Punishment: N.C.G.S. § 20-179()

 Imposed if:

  • No minor child (under 18) was present in the vehicle, and
    • Only one other grossly aggravating factor is present
  • Fine: Up to $2,000
  • Jail: Minimum of 7 days, maximum of 12 months
    • Imprisonment term may be suspended only if a condition of special probation is imposed including a minimum term of imprisonment of 7 days,
    • OR: If the individual is ordered to abstain from consuming alcohol for at least 90 consecutive days, as verified by a continuous alcohol monitoring system, of a type approved by the Division of Adult Correction of the Department of Public Safety. Up to 60 days of pretrial credit may be granted against the 90-day requirement, for voluntary alcohol monitoring prior to judgment.
    • BUT: If the defendant is subject to Level Two punishment as a result of a prior DWI conviction or driving on a license revoked as a result of a prior DWI, AND the conviction for a prior offense involving impaired driving occurred within five years before the date of the offense for which the defendant is being sentenced and the judge suspends all active terms of imprisonment and imposes abstention from alcohol as verified by a continuous alcohol monitory system, then the judge MUST also impose as an additional condition of special probation that the defendant must complete 240 hours of community service.
    • If probation is imposed:
      • Probation will include the requirement that the defendant undergo a substance abuse assessment and related treatment or education
      • Probation may include a requirement of abstaining from alcohol, monitored by a continuous alcohol monitoring system, for anywhere between a minimum period of 30 days, up to the maximum of the term of probation, along with any other lawful conditions of probation the judge should choose to impose.

Level Three DWI Punishment: N.C.G.S. § 20-179(i)

 Imposed if:

  • No grossly aggravating factors are present, and
    • Aggravating factors substantially outweigh any mitigating factors
  • Fine: Up to $1,000
  • Jail: Minimum of 72 hours, maximum of 6 months
    • Term of imprisonment may be suspended, but the suspended sentence must include:
      • Imprisonment for a term of at least 72 hours as a condition of special probation; OR
      • Community service for at least 72 hours; OR
      • Any combination of the above
  • If probation is imposed, it will include the requirement that the defendant undergo a substance abuse assessment and related treatment or education, along with any other lawful conditions of probation the judge should choose to impose.

Level Four DWI Punishment: N.C.G.S. § 20-179(j)

 Imposed if:

  • No aggravating or mitigating factors are present, or
    • Aggravating factors are substantially counterbalanced by any mitigating factors
  • Fine: Up to $500
  • Jail: Minimum of 48 hours, maximum of 120 days
    • Term of imprisonment may be suspended, but the suspended sentence must include:
      • Imprisonment for a term of at least 48 hours as a condition of special probation; OR
      • Community service for at least 48 hours; OR
      • Any combination of the above
  • If probation is imposed, it will include the requirement that the defendant undergo a substance abuse assessment and related treatment or education, along with any other lawful conditions of probation the judge should choose to impose.

Level Five DWI Punishment: N.C.G.S. § 20-179(k)

 Imposed if:

  • Mitigating factors substantially outweigh any aggravating factors
  • Fine: Up to $200
  • Jail: Minimum of 24 hours, maximum of 60 days
    • Term of imprisonment may be suspended, but the suspended sentence must include:
      • Imprisonment for a term of at least 24 hours as a condition of special probation; OR
      • Community service for at least 24 hours; OR
      • Any combination of the above
  • If probation is imposed, it will include the requirement that the defendant undergo a substance abuse assessment and related treatment or education, along with any other lawful conditions of probation the judge should choose to impose.
